You definately got to submit what they have asked for. If you feel something was done incorrectly when you filed your taxes talk to the CPA who filed it for you. Or consult some reputed CPA. In case they feel the tax returns need to be ammended you can file an ammendment pay any dues remaining and send a copy of the same to USCIS. Usually immigration process is pretty independent from IRS for most cases so you should be fine. Between your immigration lawyer & CPA you can cover what ever CIS needs.

Greeting everybody: I have been working for the same Company since 2002 first J1 then 6 years of H1-B expiring on July of this year (2009). Currently my employer is going thru the process for a Green Card with our Legal Firm and they proposed me an E Visa while the Green Card approval process is work in progress (I passed the DOL approval and I'm in the middle of the recruiting phase). I'd like to get a third party opinion if I can be granted a Green Card switching from H1-B to E Visa.
Anyone familiar with this matter?

I am in a difficult situation. I hope you can provide some guidance.
I am on 8th year of H1b. GC was messed up due to employer. A different employer has filed my labor 365 days before the I94 expires. I only have 3-4 months left on my current H1. I might have problems with my H1 transfer on time due to this new memo as I am working in layers, and I might loose my H1 status.
My wife is on F1 visa and I would like to know if
1) I can get H1 to F2 transfer. I have all recent paychecks etc and still working?
2) If I get F2, can I find a new employer who can sponsor my H1 (full time not a consultant) while in US and then do F2 to H1. I am assuming this will be a new term of H1 within the limits of the quota etc.
OR
I have to go back to my country for 1 year if I want to be on H1 again? Here I am assuming that I can re-enter the country on F2 visa then find a new sponsor. Do you see any problems with the above?

My Parents are planning to come to US sometime in th month of Aug 08, and would return back to India in Nov 08. If they want to come back in Jan 09 will that be a problem. What is the time gap that is required for a visitor to re-enter US.

I HAVE H1 APPROVED TILL 04/10 BUT I ENTERED USA USING AP THIS YEAR SO MY UNDERSTANDING IS THAT I AM ON EAD NOW WITH SPONSORING EMPLOYER. I AM ASLO DOING PARTIME JOB IN OTHER FIELD ON EAD SINCE 01/08. NOW IF I GET FULL TIME JOB WITH OTHER EMPLOYER (other field)AND IF I WORK LESS HOURS (means I get under pay than showed in labor) WITH SPONSORING EMPLOYER, WILL I BE IN TROUBLE? My current company's CEO is retiring and the other partners are forming a new company. The current company will continue as a corporation and in the new corporation the current CEO will have 10% share. The new co will start with the current client base, employees, equipment, web site and use the current company's name as a DBA.
I am on H1-B visa with the current company and in the process for Permanent Residency with my I-140 approved and awaiting for the Priority Date to become current .
If the current company terminated me and i got re-hired with the new co.. what would i need to do for my H1-B visa and the Green card process. Please advice ASAP.

If its a new company, you need to do H1B transfer and start the GC from PERM. If the I-140 is not revoked, you can retain the PD.

This is strange and I don't know if anyone has come across this situation. My I-140 is under appeal process from last 5 months and today I got this update on my I-485 that "my case has been sent to ADMIN APPEALS OFFICE location for processing ". There is no update in I-140 or I-290B forms date online. Does anyone come across same situation then please share with us. :confused:

No that is wrong assumption. H1B can be extended only based on the beneficiary's self I-140 not spouse's
Consult his/your attorney and renew H1B. At least start GC process to be eligible for H1 extension after 6 years

Hi, I have question about my case.
My family was applied I-485 by my mom's working at the company, and all my family had EAD which is working permit and received SSN with that EAD.
However, 2008 January our I-485 have got denied because of sponsor got closed.
That was the before our EAD card gets expired. So I couldn't renew the EAD card.
So My question is, is there any way to renew that EAD now?
if I still want to work, what does I have to do?
The EAD is a benefit of being in AOS --- i.e., due to pending I-485 approval. When your I-485 (I-485 applications are individual applications) was denied, your EAD stopped being valid. If you did not stop working, then you were working illegally (assuming that you had no other work VISA). So you have been out of status for more than 2 years, and possibly accrued unlawful presence for a similar period as well. If your unlawful presence accumulated to 180 days, that will trigger a 3 year ban from entering US, and a 10 year ban if the unlawful presence is 1 year or more.

Hi,
My H1B Visa expires in Aug 2009 (it was after first extension, till date i have already consumed 3 years 6 months in US). I have following questions,
1. After filing the extension next month, Can I leave to India immediately after getting the receiept (before approval). I might plan to come back to US after a year or so! I will be working at offshore for the same company.
2. If i leave a gap of 365 days, would i regain full 6 years after my re-entry in USA with the existing Visa itself?
I am very sorry if this is a repeated question, i did spend ample time investigating this query and then decided to post this in a thread.
