All,
I had posted some queries previously and thanks to all who took time to respond.
As I had said before , I have an admission to study for my MBA outside US for one year. Here is the latest update:
I was thinking I will get a one year leave abscence from my employer ( advt on the website), but apparently they dont support studies as part of the deal.
So i am out of luck;
Considering my situation what do you gurus recommend.
How can I leave US yet maintain my GC process.
My I-140 is approved
Situation:
Spouse in school Full time Studies on I-485 pending. ( entered on F1 then converted to I485..... so going back to F1 is impossible)..
I want her status to be preserved.
My thought:
Resign from my company when I need to leave. Convince them that I will return. Maintain no ties with the company for one year..basically can be compared to being jobless for one year.
and then get a letter that a future similar job will be available with the same Co. ( that sponsored my GC)...
Is this feasible ./practical?

Can anyone please tell, can the employee be trained by the employee before activation of visa i.e. 1st of October. The employer is not paying employee any wages for his training. Can his training be legal ? Is he allowed to sign any documents on behalf of the company during this training ?

Better to send the GC to India and he can enter with that GC.
His wife's GC is through his and her stay here depends on him.
So don't go for the route, to file for him as her depenant. This will make everything screwup.
Many people entered after their GC approval.
u cannot use Canada PR to enter US. If he left US without AP then his application for adjustment of status is considered abandoned.
spouse can file new application in dependent category. the dates for dependent category have come quite close since last 6 months. he could expect a GC in 6 months !

Facebook Inc. was also ordered to disable ITgrunt's Facebook page.
The order was made in response to a libel lawsuit filed by IT services and consulting firm Apex Technology Group Inc., based in Edison, N.J. against the three Web sites opposing the H-1B visa program (http://www.h1b.biz/lawyer-attorney-1137085.html). Such attacks on H1B supporters increased last year as the economic situation was gloomy, and prospects for employment were not looking good. Well, that is certainly frustrating! Your best option would be to get in touch with the designated Application Support Center to see if they can either notify the USCIS Service center of the error or have your daughter come in right away for fingerprinting. ASC phone numbers are generally not made public, but in many locations, ASC staff has provided local immigration attorneys with a phone number to use for urgent or unusual situations such as yours.
If you don't have an attorney who can call the ASC for you, you might consider just going to the ASC in person with your daughter to explain the situation and ask for their assistance.

I lost my job about a month ago with fortune company where I had my H1 and then I filed to transfer my H1 to the GC filing company. It got approved last week. They even seem to have sent the I 94 with the H1 approval.
I have a visa from the earlier company(fortune company) till dec 2009 in my passport. Do I now need to get a fresh visa again with the new (GC) company that has sponsored my H1. Or is the visa validity in my passport is good enough to work even for the new employer?

Hi company A applied for my H1 in april 1st week.
they have got 2 rfe so far and now i am not interested in working with them(they also dont seem interested in replying to the 2nd rfe)
Another company is interested in filing my h1b.
what is the safest way to go about doing this.
should i let company B know that i filed with company A before.
Also will there be any problem in getting H1b approved because of my earlier filing

You said that by AUG 2008 bulletin, your dates are current.. Which date we should refer to? Date from I-140 or date from I-485?

We are a canadian family who moved to the US about 10 years ago. We are US permanent residents; all have green cards. My husband lost his job in the US last month and we are currently staying with family in Canada until my husband gets another job. But this other job may be in Canada or in the US again. Until he gets an answer and we relocate, we would like to put our children in school so they don't fall behind by the time we get to our next destination - which could be about another month or so. If we place our children in canadian schools until then, will this jeopordize our green card or status?

I came to US on H1B visa and recently i switched my job.My previous employer (INDIAN Employer) is asking me to return original H1 petetion which they filed.
Can anyone please help me with below queries
1. Do i need Original petetion from previous employer for Green Card processing ?.
2 Should i return H1 petetion or not to my previous employer ?.
2. Is it legal requirement that i need to return original H1 petetion to previous employer who filed it ?.
I would really appreciate and thankful , if you clarify my doubts.

Recently, I have used AP for my travel from IAD. I was sponsored by company A and I am working for company B on EAD. At POE the CBP officer asked me if I am still working for Company who sponsored my GC. I said no. I told them I work for Company B. They just listened and let me in.
The other question that they asked me how long was my stay outside US. I was not sure why they asked that question.
