I am kind of worried as it has been more than 2 weeks and I have not yet recieved my EAD while my spouse's came within 3 days.
I was wondering if someone got his/her card even after 2 weeks as generally it take 5-10 days. Any advice would be highly appreciated.

Yes..you can apply for AP. It is the only way you can reenter into US. I applied for my F1 (spouse) too.
Yes you can write that same reason for the AP appplication.
BTW your F1 is not valid anymore since you showed immigration intent. You are still legal status. If you have Tuition waver/ Stipend or oncampus job...you should also apply for EAD so that you can continue to earn money.
DO check with International office in your university.

Yes you can write that same reason for the AP appplication.

I have a request / concern / what ever you would say.
Please do not cirtize if you do not like the idea, just ignore and leave the thread.
There are so many people comming to IV for other experts guidance on different things mainly on H1B status, AC21 status, AP, FP, EAD and H4 to EAD, .....
Why don't you create a general guide lines or rules or do's and don't or QA's for each topic, so that each member or visitor who come to IV can atleast go through them before asking or posting quesitons.
You can create a survery for different kinds of questions people / members / visitors might ask or have fore each topic before creating the thread so that we can have a pool of questions and answers for each topic from experts or attorney answered. (you might say we have recordings from attorney Prashanti Reddy, but it would be good if we have some thing which can be referred easily i.e., typed.
These are just some of my thoughts, it can or cannot be implemented. It depeneds on IV admins/Gurus/Experts on this forum.
Gurus, please provide your thoughts.

Is it true that H4 spouse, who do not have SSN are not eligible for tax rebate if while filing a joint tax return for 2007 ITIN is used for spouse.
It seems ITIN is given to illegal aliens too and hence it is not possible for IRS to determine which ITIN holders are legal and which are illegal. Thus they are not going to give tax rebates to ITIN holders.
My wife is on H4 and has a EAD/AP. Should I apply for SSN to receive the tax rebates? But since the tax rebates are based on 2007 tax return I will have to file the tax return using her SSN to get the rebates.
Also will SSN affect her H4 status if EAD is not used?

Supposedly there is the AC21 form, is there an example how this form should be filled, and what other documents should be included? How long does it take to approve? (for driver's license, traveling, etc.). Does it have to be filed with H1B extension?
The new job offer is 25% pay increase, otherwise very similar, could that be a problem?

Hello,
I am working on H1-B for sometime. My project ended 2 months ago and I had been on unpaid leave since then. My H1-B expires on Sep 30, 2009. My company applied for H1-B extension in June but got a RFE due to lack of evidence. My company replied to the RFE on Aug 28. and status has been pending since then. On Sep 19, I got an offer from another company. The new company filed for premium processing for H1-B transfer and her transfer application got approved with starting date of September 24. I joined the new company on Sep 29 but haven't notified her old employer yet.
My immigration is underway and has got an approved I-140 from previous employer. That is the reason I didn't notify them as I don't want to stop that process. It is my intention to move back to her old employer if the visa extension is approved and the current project is finished so that I doesn't have to refile her Green card.
Now the question is what will happen in these scenario and purportedly 'Last Action rule' of USCIS:
1) If my Visa extension gets accepted, which VISA will hold good, the H1 ext with original employer or H1-B transferred visa with new employer ? Where should I report for work and is there anything legally I need to do before I reports to any of them ?
2) If my Visa extension gets rejected, will my transferred VISA still hold good ? Will I need to do anything in that scenario i.e. need to go out of country and get her Visa stamped ?

It should be applied at the service center where your 485 is pending currently. Attach copy of 485 transfer notice with other required documents.

Dude, this is ablip, for al lwe know. So many jobs have been lost, that there are not many more to lose. Companies aer already running on skeleton crews.
Its like some person wanting to lose weight, first loses all his body fat, then not satified with it starts starving himself and starts to lose muscle mass, after that is gone, the only choice is to start cutting body parts off, to lose more weight.....
These numbers have to improve consistently for a few months, even a year for any stable, long to meadium term gains...

My mother-in-law would like to get visitor visa.
How do I answer #37 of the DS-156?
The applicant's (my mother-in-law) son( my husband) is in the U.S. illegally. I am US cit. and my husband needs to report to visa interview within the next year. We have been post-poning due to medical issues. In the meanwhile we hope my mother-in-law can come here to visit her granddaughter.( I am unable to travel). #37 of the DS-156 asks if any body is in US. We should answer YES, because her son is here, BUT, what do we put for his status? Illegal? I read one article that stated to mark YES only if he has legal status. I do not want to put NO, immigration already knows he is here and we do not want to be dishonest.
Any ideas?
She has to be truthful. Otherwise it can create big problem later. Why you husband did not apply for the card when married to a citizen?

My U.S. born son is travelling with my friends from India to USA. He had gone to India for summer vacation. Would anybody have any sample letter for addressing to immigration authorities that we authorize his travel along with my friend.

US born child is citizen by birth and has RIGHT to enter United States. Immigration officials cant deny him the right to enter USA.
A simple letter saying that you have authorised your friend to accompany your child (minor) for the travel. The letter should have your contact address, cell etc

I guess tricks isnt the best word to use, i have had photo courses, and have had the rule of thirds pounded into my head by many a teacher ;)
