    I want to extend the stay for my Parents for few months. They are on visitors visa. I am aware that I need to file form I - 539 for this purpose. I am not sure what reason should I specify for extention?
    If some one had done extention for visitors visa in past please, I would appereciate your help on this.

    Get it Notarized with photo and send the document.There are standard formats available.
    If it is Power of Attorney to deal in property matters on your behalf, then the notarized copy also needs to be stamped by the Indian Consulate in your area.

    So there is one more loop involved - to get it endorsed by Indian Consulate, after you have done the notarization. I believe this is something that has become applicable recently as I had to do it last month. A few years ago when I had done the first one, it was just preparing the POA document, and getting it notarized.

    Hi Guys,

    I got my I140 denied and one attorney suggests that I can file for New I140 and also Appeal to AAO office at the same time, another one suggests that if appeal is filed USICS will not process I140 until the decision is made on Appeal, did any one file file both new I140 and Appeal at the same time and got result for I140 earlier than Appeal.

    I had a soft touch on my LUD for I-485 yesterday. Have received EAD card and been fingerprinted. Waiting for AP approval. Does anyone have a clue what is this in regards to?

    I'm from the Philippines and Mar. 28, 2006 is my PD. My question now is, what if by June (by God's grace) my PD will be processed. How many more months should I wait before receiving my packet 4? considering that certain documents (ds230,nbi) need to be updated & be sent to them. A total of how many more months should I still need to wait before my embassy interview?

    Company A can not by law press any charges for the filing fees of H1B petition but they might go after you to pay for other costs in case you have agreed to pay for attorney fees.

    does the employment letter have to be exactly in the same format as described in 'filing your 485 on your own thread' or can it be a simple letter stating the job title, salary, responsibilities etc?........is it ok to file 485 on my own eventhough the rest of the process was handled by attorney?.......for any immigration matters my company just forwards me to their lawyer.......and there is chance the lawyer might get pissed off if I file 485 on my own.......any ideas?

    It can be in any format as long as it lists your title and duties exactly as it is stated in your labor certification.

    It thus appears that those who are scheduled for IV interviews should keep the schedule of interviews in July regardless of the current Visa BullEtin fiasco.     this makes it very hard for people who jumped jobs in their 7th/8th years with 1 year extensions from new employer. All were hoping to get LC+I_140 done within that year so they are eligible for further H1B extensions.

    Is it mandatory to spend [B]at least[B] 6 months residing in the US every calendar year after obtaining a GC? :confused:

    If your stay is less than 1 year abroad, you can reenter using just your green card. If you want to stay 1-2 years outside the U.S, you will have to apply for a reentry permit before departure. But, it will be considered as a break (i.e, more than 1 year abroad) in the continous residence requirement of 5 years when it comes to your naturalization application.

    If you want to stay longer than that, you will have to apply for "returning resident permit" for which you need to prove that your intent is to be a permanent resident but, your stay abroad longer than the period of the reentry permit was beyond your control.

    Please consult an attorney so that you don't lose your PR.

    I was looking through my LC and 140 documents and found out that there are two different job titles in LC. One is Employer Job title which is "Analyst Programmer" other one is prevailing wages occupational title which is "Computer Systems Analyst". My question is what should be my Title at new employer?

    Does your employer do all the work or the lawyer?

    All H1 extensions are now processed in California (I think). So you should get the WAC number (EAC-Vermont,LIN-Nebraska,WAC-California,SRC-Texas). And my employer's lawyer sent the application end of may (31st I think) and we received a notice dated June 8th.

    I agree that option B is the correct choice. They are looking for you to have a stable residency, so having it established as the application time nears makes the most sense. Still, I would consult with an expert or an attorney if you have the opportunity.

    Hello everybody,

    Since my last post I have done a lot of research on this site and i think i have found the answer to most things. I am curious to find out if anyone has been in the same situation and have a couple of questions left.

    1. Since now I am married but when my I-485 was filed I was single, do I need to ammend the I-485?
    2. Do I need to let the attorney know that we are self filing for my wife?

    Hello,

    First of all, I really appreciate your efforts to help people in their immigration issues.

    Currently, I am on H4 visa. Recently, I was offered employment and got my H1B approved.
    But, my new I797 approval notice does not contain I-94 part.

    Do we need to apply for Change of Status from H4 to H1B now while I remain in US? Do I need to do it or my employer needs to do it?

    I would really appreciate your help.

    You need to go out of US, preferably to your home country, get an H1-B stamp on your passport, and reenter US using your H1-B visa stamp.
