Instead of starting a new thread. I would appreciate if someone answers a few questions regarding Check details that we send out to USCIS.
Went to lawyers office last week and signed all the applications. I made out onc check in the amount of $745 ($395 I-485 + $170 I-131 (AP) + $180 I-765 (EAD)) Payble to U.S Citizenship and Immigration Service. Now when I see the forms online it says the checks should be payable to Department of Homeland Security. Should I ask the lawyer to hold on to the application and send new checks.
Also , should I write three separate checks for $395 $170 $180. Just to make sure if there is an error in say Advanced payroll application, USCIS will keep the two check and send me back the Advanced Parol application.
Making separate checks is highly desirable and one should always follow that path. Hello,
I have an unfortunate situation. My parents names are misspelled in the Birth certificate compared to the Passport parents name page. Do we need to submit the parents names page of the passport when we submit our documents for 485 ?? Please let me know if this will be a problem and if there is a work around for this ??
Also if I have a Birth certificate (with my actual full name - dated in 2007 though), do I need to submit the affidavits ??

It would be better to get affidavits from your parents ,if u submit without affidavits u might get a RFE and this might delaying your process.

It would be better to get affidavits from your parents ,if u submit without affidavits u might get a RFE and this might delaying your process.

Online case status and infopass are useful for things like address change, namecheck status, finger printing issues , and other issues being dealt where no processing or less processing is required like GC not received, approval not received , letters lost etc...
When it comes to such complicated issues, you have to get real help.
Basically - you have to somehow cut through beurocracy and get your issues resolved.
Good luck, I am sure, things will get under control soon.

I thought it would be very helpful because I can talk to IO face to face and explain my situation in detail. One thing I would appreciate about IO is she was very patient and she tried to understand my case fully. But at last she said she cannot help me. She said the only option I have left is just to wait to hear from AAO. She said her daily job is to give the latest status of the cases, giving immigration forms and help people if they have any doubts.
I asked her that can I file EAD when my MTR for I485 is pending with AAO? She was not sure about it. Then she made a call to Nebraska Service Centre and found out that I can file EAD. I need to attach I290B receipt along with EAP application form. I am just wondering has any one has done this before? Is that really possible?

if u register at uscis as a customer, then u can create ur profile and add ur cases to it as a portfolio. once u do that all ur cases will be listed in a tabular column fashion, and one of the columns is 'last updated date'. u cud sort on that column to regularly see if anythings hapening on ur case.

This procedure in CT is bind boggling , the reason for all this headache is My wife got a job in CT and my Job is in IL. I requested my employer whether he would allow me work remotely ( i am a consultant though) they agreed for it and HR manager got back to me saying even though u r changing residing address , and since ur working remotely in IL there is no need of change of worklocation amendment for LCA or H1B . Now CT DMV says they need an CT employer Letter or else they will not issue a license .. system ... this procedure is not commendable. if nothing works i feel i have no other option continue maintaining IL State plate and License.

Maybe yes - Quality of Life is highly subjective and personal. For example, I value very highly how I am treated at my current employer. I love the work, the people, and my environment. I have some potentially VERY exciting projects coming up in the next few years that could do wonders for my resume. I've been at the same company for 5 years and have built up some serious company loyalty :)
Also, are you talking about the risk involved in changing jobs because of H1B transfer process. Because I am a contractor and all consulting companies are MORE or LESS the same. They all try to make money out of you. So I am trying to understand what kind of risk is that.
Your thoghts are important. Please let me know.

For me, the risk involved in changing a job just so I can jump into an EB2 category is too great. By risk, I mean losing the work environment, colleagues, potential experience - THAT is the quality of life I would be giving up. Of course, your job sounds entirely different, being a consulting basis. So I can totally appreciate how you may prioritize differently - meaning finalizing your green card status as soon as you can.
If I was in your shoes, yes - I would probably do exactly what you are thinking of.
Like I said though, its a personal choice

"The Address Printed On your checks Must Match the adress given in work sheets[in 485]"
I am confused,will they accept the application,checks are not cashed yet,applied on july18th
Please Help

We know IV has set policies about postings, but i have to agree with Jnayar here. It is really a waste of time and counterproductive for individuals to be on 2-3 different forums. Especially when the creme-de-la-creme is on this one.
I mean at max, some people will read the issues and not post a reply, but if someone DOES have an answer, it would make life easier on the person that posted the question. From my personal experience, i used to visit the ImmigrationPortal religiously during the past year. Now i have not once stepped onto that forum, coz most of my needs regarding information are met here. We have a strong, vast and diverse community on here and we can help each other out, being that most Immigration Lawyers are not very prompt in answering our questions. You guys have been doing a great job moderating this forum, but we need to have a seperate category for these extra issues.
Adding another forum should not be too big of an issue in my opinion, though the Admin could shed some light on this.
All people have to do is monitor two forums. That is exactly what I do. When my application was sent off to the Texas Service Center from the CSC, I posted on Immig Portal not here.
We do not want IV to become just another forum. We want to keep our activism at the forefront. And we want the "creme de la" as you call them to focus on the work at hand not answering every question that comes along. If you are familiar with Immig Portal you know that the same question is asked repeatedly, misinformation is spread and moderators have enough to do without getting involved in all that. Not to mention frayed nerves, name calling and the all the rest of it. As it is it is hard to keep people on topic in any given thread. I am not sure you know about the behind the scenes work needed to keep this forum accurate, civil and on point.
Please understand that we think of Immig Portal as a complementary forum. We were born there, and we think it is the appropriate forum to discuss processing issues.
And as for extra time, think of all the extra time IV volunteers are spending just getting basic IV work done. Spend the extra 5 mins to go to Immig Portal.

Now you mentioned that if I port my PD from an old EB2 to a new EB2 (same category), I will not save any time. Please clarify.

To give you an example, consider the following:
1. From employer A, your EB2 Priority Date is July 7th, 2006 and your country of chargeability is India. Per the Oct. 2010 visa bulletin, your date is not current.
2. You change employer to employer B who files your PERM on July 17th, 2010 and you get it approved followed by I-140 approval as well (premium processing)
3. PD from second employer's EB2 GC process is July 17th, 2010 - but due to earlier approved I-140 you are able to port your PD and hence the PD on your second I-140 approval is July 7th, 2006 (assuming that the attorney asked for porting of PD).
4. From both your approved I-140 - your priority date is still July 7th, 2006. However, from Oct. 2010 visa bulletin, cut off date is May 8th, 2006. So your date is still not current. For your date to be current, the cut-off date has to be July 8th, 2010 or later.

Just produce the docs thet asked. As for the pay difference, the labor mentioned salary is supposed to be paid to you once you receice GC. Don't worry about it.

No issues for me when I came back on H1B on 4/20/2009.
I had a H1B stamped on my passport from my previous employer and I was carrying new H1B approval notice from my current employer. I got I-94 till the validity of my new H1B approval from my current employer.
No issues whatsoever, no question asked and it was smooth sail.
